Patience Jonathan: court strikes out suit against SERAP

A Federal High Court in Lagos, has struck out a suit by a gathering, the Union of Niger Delta Youth Organization for Equity, Justice and Good Governance, against the Socio-Economic Rights and Accountability Project (SERAP).

The gathering had recorded the suit in the interest of previous first Lady, Dame Patience Jonathan, looking to prevent SERAP from arraigning Mrs Jonathan over assertion of illegal tax avoidance.

Equity Mojisola Olatoregun on Wednesday struck out the suit after the gathering connected to court for a withdrawal of the suit. The offended party had blamed SERAP for utilizing on the web, print and electronic media to distribute pernicious charges against the previous first woman, denouncing her to having stolen 15 million dollars.

The gathering, in the case, had supplicated the court for a request of interval order limiting SERAP from making any further strides in judgment of the previous First Lady either in all open media or through legal process

It said the battle by SERAP was in break of Jonathan's entitlement to be assumed blameless until demonstrated blameworthy under Section 36(5) of the 1999 Constitution of Nigeria (as revised).

Accordingly, SERAP had contended that the gathering was not enlisted as given by the Companies and Allied Matters Act, and in this manner did not have the lawful appropriate to found an activity. Advice to SERAP, Mr Timothy Adewale, had depicted the suit as an entire "exercise in futility".

The News Agency of Nigeria (NAN) reports that five organizations had on Sept.15, 2016, confessed to washing around 15.5 million dollars after their arraignment before Justice Babs Kuewumi.

The organizations are: Pluto Property and Investment Company Ltd, Seagate Property Development and Investment Company Ltd, Trans Ocean Property and Investment Company Ltd, and Avalon Global Property Development Ltd.

Taking after the organizations' request, an indicting counsel for the Economic and Financial Crimes Commission (EFCC), Mr Rotimi Oyedepo supplicated the court for a request of relinquishment of the cash to the Federal Government. However, the previous first woman, who lay possession claim of the monies in the organizations' records, has likewise documented a suit trying to unfreeze the records.
